The Housing Fund of the Republic of Slovenia hereby publishes the following in accordance with the provisions of Article 52, paragraph 2 of the Act on State and Local Government Property (Official Gazette of the Republic of Slovenia, No.11/2018 and 79/2018) and Article 19 of the Regulation on State and Local Government Property (Official Gazette of the Republic of Slovenia, No. 31/2018) the intention to conclude a contract on the free use of immovable property with the ID number part of the building 660-4798-213, part of the building 660-4798-506, part of the building 660-4798-507, part of the building 660-4798-508 and part of the building 660-4798-509.

The free use of the property is rented out on a “seen – rented” basis for a period of 1 (one) year. The property is not being rented out for residential purposes, but for the purpose of providing a public service in the field of pre-school education in two kindergarten sections and accompanying activities.

The intended tenant is a public educational establishment operating in the public interest for the purpose of carrying out a public service (public tasks) in the field of pre-school education.

Only interested bidders who wish to lease the property under the terms of Article 68 of the Act on State and Local Government Property for the performance of public service (public tasks) in the field of pre-school education may submit a bid. They must enclose a certificate of registration as a public institution operating in the public interest in the field of early childhood education.

The rental period is 5 (five) years, with the possibility of extending the rental contract. The property is not being rented out for residential purposes, but for humanitarian activities.

The intended tenant is a non-governmental organisation operating in the public interest for the purpose of carrying out humanitarian activities in the field of social welfare.

Only interested bidders who wish to rent the property on the above conditions for the purpose of carrying out humanitarian activities in the field of social welfare may submit a bid. The Housing Fund of the Republic of Slovenia, a public fund, intends to conclude a sale contract with the Municipality of Sodražica, Trg 25. maja 3, Sodražica, which is a co-owner of the subject properties, after the expiry of a 20-day period from the date of publication of this intention. In the sale of co-ownership interests, according to Article 66 of the Civil Procedure Code (Official Gazette of the Republic of Slovenia, No.87/2002, 91/13 and 23/20), co-owners have the right of pre-emption over the real estate.

Publication of the intention to directly purchase the property in question pursuant to Article 54(4) of the ZSPDSLS-1 is necessary because both parties to the transaction are legal persons governed by public law. The sale of the property will be carried out in accordance with the provisions of the ZSPDSLS-1.

The apartment has a proportional ownership interest in the common parts, facilities and land. The property is in need of major renovation.

The property is subject to a legal pre-emption right under Article 124 of the Civil Procedure Code (Official Gazette of the Republic of Slovenia, No. 87/2002, 91/2013 and 23/2020). Publication of the intention to directly purchase the property in question pursuant to Article 54(4) of the ZSPDSLS-1 is necessary because both parties to the transaction are legal persons governed by public law. The exchange of real estate will be carried out in accordance with the provisions of the ZSPDSLS-1.

The procedure for concluding a lease contract can be suspended at any time until the transaction is completed.

INTENTION TO CONCLUDE A DIRECT CONTRACT FOR THE SALE OF IMMOVABLE PROPERTY

Subject of sale

 

  1. The subject of the sale is:

plot 2175 1237/10 measuring 1,896 m2

The property with parcel no. 1237/10, cadastral municiplaity Jesenice is located in the central area of central activities. By the Decree on the Municipal Detailed Spatial Plan Partizan (Official Gazette of the Republic of Slovenia, No. 139/2020), the subject property is located in the functional unit F2, where the construction of two multi-apartment buildings and the arrangement of a public park area is planned.

In accordance with the Decree on the pre-emptive right of the Municipality of Jesenice (Official Gazette of the Republic of Slovenia, No. 45/2003), the Municipality of Jesenice has the pre-emptive right on the property with parc. no. 1237/10, cadastral municipality Jesenice. Since the Housing Fund of the Republic of Slovenia is a public fund and a public law entity established by the Republic of Slovenia, the Municipality of Jesenice cannot exercise the pre-emption right in accordance with Article 190, paragraph 1, subparagraph 2 of the Act on Spatial Planning (Official Gazette of the Republic of Slovenia, No. 61/2017).

 

2. Value of real estate

The value of the property, as derived from the Market Value of Real Estate Report by Klinar Danilo, is EUR 16.80/m2 or EUR 31,852.80. This price does not include 22% VAT payable by the buyer.

 3. Conclusion of the contract

The announcement of the intention to directly purchase the subject property in accordance with Article 54(4) of the ZSPDSLS-1 is necessary because the acquirer or purchaser of the property is the Housing Fund of the Republic of Slovenia, a public fund, which is a legal person governed by public law.

Negotiations have taken place between the parties. The price and other elements of the tender offered in writing or agreed in the negotiations shall be binding.

The direct contract under this intention will be concluded after 20 days from the date of publication on the website https://ssrs.si/ .

 4. Method and time limit for payment of the purchase price

The payment of the full purchase price within a specified period of time is an essential element of the transaction and will be regulated in a direct contract in accordance with the provisions of the legislation binding on public law entities, since the buyer is a public law entity.

 

5. Conditions and method of submission of the tender

Given the fact that the Housing Fund of the Republic of Slovenia is purchasing the property in question for the purpose of completing plots within the OPPN Partizan, where it plans to build two multi-apartment buildings with public rental housing units, the intention to purchase the property in question is thus clearly expressed in this notice.

INTENTION TO CONCLUDE A DIRECT CONTRACT FOR THE FREE RENTAL OF THE HOUSING UNIT

The Housing Fund of the Republic of Slovenia, a public fund, intends to conclude a direct contract for the free use of the apartment for a period of five years with the Foundation for Assistance to a Child with Cancer, Bohoričeva Street 20, Ljubljana, after the expiry of a 20-day period from the date of publication of this intention. In the event of the loss of the status of an NGO granted public-interest status for the activities for which it has been granted status, the free-use contract shall also expire before the expiry of a period of five years from the date of conclusion of the contract.

The publication of the intention to conclude a direct contract for the free use of a housing unit in accordance with Article 68(1)(2) of the ZSPDSLS-1 is necessary because the Housing Fund of the Republic of Slovenia, by means of the direct contract method, grants to a non-governmental organisation, which has been granted the status of an organisation operating in the public interest, for the purpose of carrying out the activities for which it has been granted the status, the free use of real property in a multi-apartment building at Topniška Street 45 in Ljubljana, namely housing unit no. 40 on the 5th floor with an area of 92.93 m2 with identifier 2636-7735-198 (ID 5799644), to which belongs a storage room with an area of 4.13 m2 with identifier 2636-7735-199 (ID 5799645).

INTENTION TO CONCLUDE A DIRECT SALES CONTRACT

The Housing Fund of the Republic of Slovenia announces its intention to sell a storage room with ID: 1727-1064-204 – according to GURS data of the area: 6.60 m² in Ljubljana, Mesarska cesta 34. The storage facility does not have a separate electricity point, which is currently connected to a common electricity point, so the application is more suitable for the owners of the housing units at the address Ljubljana, Mesarska cesta 34. In the event that the purchase is not made by the owner of the apartment at the storage address, the potential purchaser must provide a declaration that he will provide a new electricity point at his own expense or that an electricity meter will be installed, and that the meter reading must be reported to the building manager on a monthly basis or as subsequently agreed. The relevant declarations must be submitted before the conclusion of the sales contract. The Housing Fund of the Republic of Slovenia does not bear any costs for this purpose.

Intended direct contracts for consideration

The Housing Fund of the Republic of Slovenia, Poljanska cesta 31, Ljubljana, in accordance with Article 52 of the Act on Real Property of the State and Self-Governing Local Communities (Official Gazette of the Republic of Slovenia, No. 11/2018 and 79/2018; hereinafter: ZSPDSLS-1) announces its intention to conclude a direct contract for the gratuitous use of the office space with ID No. 2175-1401-46 with an area of 280.9 m² at the address Jesenice, Industrijska ulica 2 a. A contract for gratuitous use will be concluded with the Theatre Toneta Čufarja Jesenice, Toneta Čufarja Square 4, Jesenice, for the purpose of storage. According to Article 68(4) of the ZSPDSLS-1, the tenant will have to bear the operating costs, the costs of minor maintenance works, the insurance costs and a pro rata share of the costs of managing the building. The tenant will have to vacate the premises if the owner needs them or if they are sold. The lease agreement is concluded for a maximum period of 5 (five) years. The Tenant will not be allowed to register a registered office at the address of the leased premises or to sublet the premises for free.

In the event that the Housing Fund of the Republic of Slovenia receives declarations of interest from interested parties other than those mentioned above within the deadline, it will also negotiate with them the possibilities and conditions for concluding the transaction. The declaration of interest should include information about the entity and purpose of use and unconditional acceptance of all the above requirements of the Housing Fund of the Republic of Slovenia in case the tenderer/interested entity is selected. Preference will be given to any offers for the longest possible (up to five (5) year) rent-to-own lease. In this case, the Housing Fund of the Republic of Slovenia will negotiate the price and other terms of the transaction with all tenderer and select the most advantageous tenderer in accordance with the principle of economy. The Housing Fund of the Republic of Slovenia may suspend the procedure until the transaction is concluded.
